1. Who this is between
This Creator Program Agreement (the "Agreement") is between Pre Closing Inspection, Detroit, Michigan ("PCI", "we") and the person who signs it below ("you", "Creator"). Version CP-2026-10-21.
2. Independent relationship
You are an independent promoter, not an employee, agent, partner or franchisee of PCI. You may not sign contracts for us, speak for us, perform or offer to perform inspections, or give opinions about the condition of any property.
3. Who can participate
You are at least 18, live in the United States, and are not a real estate agent or broker, mortgage lender or loan officer, title or settlement service provider, home inspector, or anyone else who receives compensation from a real estate transaction. PCI does not pay real estate agents, or the other professionals listed here, commissions, fees or anything of value for referring or sending inspections. If you are one of them, do not sign up as a creator. Agents work with us through the Nexus Network instead, as described on the Creator Program page under "Real estate agents".
4. Commission
You earn 25% of the inspection fee we actually collect, including add-ons, on each paid inspection booked through your link or tracking code. A booking is credited to you if the client used your link within 30 days of their last click on it (last click wins). A commission becomes payable 14 days after the client has paid. No commission is earned on cancelled, refunded, charged-back, unpaid or no-show inspections, on taxes, or on bookings made by you, your household or your own business. If a commission is paid and the fee is later refunded or charged back, we may deduct it from future commissions. Commissions are paid when your balance reaches $25. We may change the commission rate for future bookings on 30 days' notice. This program is voluntary; no income is guaranteed and no minimum is required.
5. Payment, Stripe and taxes
Payments are sent through Stripe Connect. You must connect and complete a Stripe account (including identity and tax information Stripe requires) before any payment can be sent. Commissions are not paid to creators who have not completed Stripe setup. You are responsible for your own taxes. We may issue tax forms where the law requires and may withhold payment until the information we need is provided.
6. Disclose every post
The FTC requires that anyone paid for promoting a business must clearly say so. In every post, video, story, stream, comment, bio link or other piece of content that promotes us or contains your link, you will clearly and conspicuously disclose the relationship (for example "#ad" or "I earn a commission when you book through my link") at the start of the caption, and by voice and on screen in video. Using only a disclosure hidden in a bio, or buried among hashtags, is not enough.
7. Honest promotion
You will use only claims, prices and descriptions found in the materials we provide or on our website. You will not: guarantee outcomes or promise what an inspection will or will not find; present yourself as an inspector or employee; publish fake or purchased reviews, or testimonials from people who were not our customers; offer discounts, gifts or anything of value to clients that we have not approved; spam, send unsolicited texts or emails, or violate CAN-SPAM, TCPA or platform rules; bid on our name or variations of it in paid search; register domains, handles or accounts that use our name or could be confused with ours; or use content that is unlawful, obscene or discriminatory next to our brand.
8. No disparagement
While you are in this program and for 12 months after it ends, you will not make or publish false, misleading, defamatory or disparaging statements about PCI, its owner, inspectors, staff, services, reports or prices, in any channel, including your own, comments, reviews, replies and private groups you control. If you have a concern, please tell us first at winning@preclosinginspections.com so we can fix it. This section does not restrict: an honest review of a service you personally bought from us, based on your genuine experience; truthful statements to a government agency; testimony or statements required by law; or any right that the law does not allow to be waived, including under the Consumer Review Fairness Act.
9. Channels and monitoring
You have listed every social account and channel where you will promote us. You will promote only on listed channels and tell us within 7 days of adding another. You agree that we may view, save and review your public content and accounts that promote us, and you will remove or correct any content that breaks this Agreement within 48 hours of our request. Commissions may be withheld on bookings from unlisted channels or content that breaks this Agreement.
10. Our materials and your content
We give you a limited, non-exclusive, revocable license to use the logos, images, videos and copy in the creator kit to promote us as this Agreement allows. Do not alter our logo or imply endorsement beyond what we state. You keep ownership of content you make, and you give us a free license to share it, with credit to you, while you are in the program.
11. Client privacy
We do not share client names or contact details with you. You will not collect personal information from people on our behalf or give us anyone's information without their consent.
12. Term and ending
Either of us may end this Agreement at any time by notice (email is enough). We may suspend or end your participation immediately if you break it. After ending, you will stop using our materials and remove your tracking links within 7 days. Eligible commissions for bookings made before the end will still be paid, except where fraud, misrepresentation or a breach of sections 6, 7, 8 or 9 is involved.
13. Responsibility
You are responsible for your content. You will defend and reimburse PCI for claims, losses and reasonable costs that come from your content, your breach of this Agreement, or your violation of law. The program and materials are provided as-is. PCI's total liability to you under this Agreement is limited to commissions you have earned and not yet been paid.
14. General
This Agreement is governed by Michigan law, and the courts in Wayne County, Michigan are the place for disputes. It is the whole agreement about the program. If part of it is unenforceable, the rest stays in force. You may not assign it. We may update it by emailing you 30 days ahead; continuing to participate after that date means you accept the update. By typing your name and submitting the form you agree to sign electronically, and that this is as binding as a handwritten signature. We record the date, time, version, and your IP address with your signature.
